GENERAL TERMS AND CONDITIONS OF SALE


The present general conditions of sale govern all relationships between:
the company JOAQUÍN ESPALIÚ SILVER JEWELRY
and its online customers (“The customer”).
Before making any transaction, the customer acknowledges that they know and declare that they accept these conditions from the moment they click the Accept button.

 

1/ Particular conditions of sale
The customer acknowledges knowing, at the time of placing the order, the specific sales conditions indicated on the screen (name, price components, weight, quantity, color, product details, cost of services, etc.) and expressly declares to accept them without any reservation. The placement of the order and its confirmation by the customer materialize the full and complete acceptance of the specific sales conditions, applicable only to the order.

 

2/ Order
The customer places the order by clicking on the "add to cart" tab. The order is added to a total that collects all the items confirmed by the customer by clicking on the "I accept the general sales conditions and proceed to payment" button in the menu bar.
The automatic registration systems of JOAQUÍN ESPALIÚ SILVER JEWELRY serve as proof of the nature, content, and date of the order. The customer must print and send to JOAQUÍN ESPALIÚ SILVER JEWELRY the purchase request for orders over 500 euros (cost of the merchandise, VAT included) that appears on the screen, duly signed. Likewise, the customer must attach the present general sales conditions on paper, duly signed. Otherwise, orders over this amount will not be considered and will not be legally valid.

 

3/ Order confirmation
JOAQUÍN ESPALIÚ SILVER JEWELRY confirms the acceptance of your order to the customer through the medium of their choice: email, fax, or postal mail. The sale will not be finalized until the company JOAQUÍN ESPALIÚ SILVER JEWELRY confirms the order.
JOAQUÍN ESPALIÚ SILVER JEWELRY reserves the right not to confirm an order for a specific reason such as product supply, an issue related to the received order (e.g.: illegible document), an abnormal order, or a foreseeable problem regarding delivery. JOAQUÍN ESPALIÚ SILVER JEWELRY will inform the customer.
No new orders can be placed until the customer has made payment of the amounts due for previous orders. Likewise, ownership of the merchandise will not be fully transferred until the company JOAQUÍN ESPALIÚ SILVER JEWELRY receives the amounts owed by the customer.

 

4/ Delivery conditions of orders
The customer will choose the place and date of receipt of the merchandise at the time of placing the order. JOAQUÍN ESPALIÚ SILVER JEWELRY reserves the right to use all necessary means to deliver the products to the address indicated by the customer. Deliveries will be made within the territory of Spain (including the Balearic Islands and Canary Islands) and outside of it. Shipments abroad and to the Canary Islands: By accepting the general conditions, the customer agrees to pay the customs fees.

 

5/ Delivery times.
The standard delivery time for the national territory is 4 to 6 days. However, depending on the selected jewelry and its production process, this period may extend up to 15 days or more.

For international deliveries, the delivery time may vary due to the possibility of customs inspections depending on the destination country. Please note that this process may add a few additional days to the estimated delivery time.

All orders will be provided with a tracking number, allowing customers to track the progress of the delivery at each step of the process.

 

6/ Delivery and reception costs of orders.
Spain and International:
Delivery costs amount to 6.90 euros (VAT included) for baskets under 79 euros (VAT included) (without delivery costs). For all baskets equal to or greater than 79 euros (VAT included), shipping costs will be free. 


By placing an order, the customer agrees to sign the receipt presented by the person making the delivery, in which they may include any observations they deem necessary. By signing the receipt, the customer acknowledges having received the number of packages indicated on it. If the customer notices damaged products or missing items, they must file a complaint with Customer Relations via email or by postal mail to JOAQUÍN ESPALIÚ SILVER JEWELRY, within a maximum period of three days.
Any event such as, for example, force majeure, disaster, strike, administrative decision, or transport strike that delays, prevents, or makes supply exorbitant, constitutes, by express agreement, a clause for the suspension or extinction of the obligations of the company JOAQUÍN ESPALIÚ SILVER JEWELRY, without compensation in favor of the customer if the event occurs for more than 15 days. Under these circumstances, the customer will be completely and automatically exempted from their obligations regarding their order.
The company JOAQUÍN ESPALIÚ SILVER JEWELRY will inform the customer through any suitable means and on the same day that such an event occurs so that they can freely cancel their orders by responding via postal mail or e-mail once notified of the event.
When the delivery of the merchandise to the customer cannot be made due to the latter, the company JOAQUÍN ESPALIÚ SILVER JEWELRY reserves the right to charge a preparation fee of 6.90 euros (VAT included).

 

7/ Shipping company
Deliveries will be made by the postal service or by courier during normal office hours. Please select the shipping address so that someone can receive the package.

 

8/ Price
All prices are indicated in euros and include VAT. The price billed to the customer is the price indicated in the order confirmation sent by JOAQUÍN ESPALIÚ SILVER JEWELRY. Payment for products and services is made by credit card in a secure environment on our provider's server. The charge on the customer's credit card will be made in euros 2 days after the order is accepted by JOAQUÍN ESPALIÚ SILVER JEWELRY. JOAQUÍN ESPALIÚ SILVER JEWELRY retains ownership of the products until the customer has fully paid the price of the products and services.


9/ Product sheet
The photographs showing the products are provided for indicative purposes only. The texts accompanying these photographs are a reproduction of information found on the packaging or the instructions for use. The differences between the photographs and the products can only be minimal and do not affect the essential characteristics of the products. The color of the products shown in the online store may differ from the actual color of the product.


10/ Payment conditions
The requested products will be delivered after payment by credit card (Master Card, Visa Card, American Express).

 

11/ Security of private information
JOAQUÍN ESPALIÚ SILVER JEWELRY is obligated to protect your private information. The personal data collected during your connection to our commercial site will only be used to process your order. We will not sell, lease, or disclose your personal data to anyone (nor to third parties).

 

12/ Requested information
By placing orders through the site www.JOAQUINESPALIUSILVERJEWELRY.com, you consent to the company JOAQUÍN ESPALIÚ SILVER JEWELRY using personal data about you, provided by you or collected through the operation of the site. This data (names, email address, postal address, credit card number with its expiration date, etc...) is necessary for us to process your orders.

 

13/ Personal data security
Order shipping (contains information about your account) is done through a secure server. The security program (SSL) encrypts all the information you enter before it is sent to us. Likewise, message transmissions are protected against unauthorized access by third parties.

 

14/ Warranty
The customer will benefit from the legal warranty for hidden defects in the products sold. All our products are designed and manufactured with the utmost care possible. However, the warranty will not be valid if failures or damages occur due to improper handling, lack of maintenance, or care contrary to our instructions for use. The buyer must consult the appropriate instructions and recommendations found in the user manual provided with the product.

 

15/ Right to return goods and withdrawal period
The customer has a withdrawal period of seven days from the receipt of the merchandise to return, at their own expense, the products* to JOAQUÍN ESPALIÚ SILVER JEWELRY in order to exchange them or obtain a voucher for the same amount as the purchase, to the following address:

If the company JOAQUÍN ESPALIÚ SILVER JEWELRY fails to fulfill its obligation to confirm the order, the withdrawal period will be three months, starting from the day the customer receives the items. If during this three-month period the confirmation is provided by email and the consumer acknowledges receipt of it, the period will be seven business days from that confirmation. In the event of exercising the right of withdrawal, the company JOAQUÍN ESPALIÚ SILVER JEWELRY must refund the amounts paid to the customer, at no cost. 
* In its original complete packaging (accessories, instructions, etc.) in good condition and accompanied by a copy of the invoice.

 

16/ Intellectual property
When connecting to the website created by JOAQUÍN ESPALIÚ SILVER JEWELRY®, holder of all intellectual property rights, the customer may not copy or download all or part of its content without prior and express authorization from JOAQUÍN ESPALIÚ SILVER JEWELRY®.
