GENERAL TERMS OF SALE
These general terms of sale govern all relationships between:
the company JOAQUIN ESPALIU and its online customers (“The customer”).
Before making any transaction, the customer acknowledges being aware of and declares acceptance of these terms from the moment they click the Accept button.
1/ Specific terms of sale. The customer acknowledges being aware of, at the time of placing the order, the specific terms of sale indicated on the screen (name, price components, weight, quantity, color, product details, cost of services, etc.) and expressly declares acceptance without reservation. Placing the order and its confirmation by the customer constitutes full and complete acceptance of the specific terms of sale, only applicable to the order.
2/ Order. The customer places the order by clicking on the “add to cart” tab. The order is added to a total that includes all items confirmed by the customer by clicking the "I accept the general terms of sale and proceed to payment" button on the menu bar.
3/ Order confirmation. JOAQUIN ESPALIU confirms the acceptance of your order to the customer through the medium they choose: email, fax, or postal mail. The sale will not be finalized until JOAQUIN ESPALIU confirms the order.
JOAQUIN ESPALIU reserves the right not to confirm an order for specific reasons such as product supply, an issue related to the received order (e.g.: illegible document), an abnormal order, or a foreseeable delivery problem. JOAQUIN ESPALIU will inform the customer.
No new orders can be placed until the customer has paid the amounts due for previous orders. Additionally, ownership of the goods will not be fully transferred until JOAQUIN ESPALIU receives the amounts due from the customer.
4/ Delivery terms of the orders The customer will choose the place and date of receipt of the goods at the time of ordering. JOAQUIN ESPALIU reserves the right to use all necessary means to deliver the products to the address indicated by the customer. Deliveries will be made within Spain (including the Balearic and Canary Islands) and beyond. Shipments abroad and to the Canary Islands: By accepting the general terms, the customer agrees to pay customs fees.
5/ Delivery times. Deliveries will be made, provided the purchased item is available in stock, within the national territory, within 8 working days but may take up to 15 days depending on the type of jewelry, as some, due to their production process, take longer than others. If an item is not in stock at the time of ordering, we will inform you and confirm the date it will be available again or offer you an equivalent substitute product. Delivery is at the recipient's expense.
6/ Delivery costs and receipt of orders Shipments will be made by express transport. The cost, for mainland and Balearic Islands, is included in the purchase price. For Europe (Belgium, Italy, Netherlands, France, Germany, and the United Kingdom) there will be an additional cost of €6.90.
If the customer notices damaged products or missing products, they must file a claim with Customer Relations Service by email or postal mail to JOAQUIN ESPALIU, within a maximum of three days.
Any event such as, for example, force majeure, disaster, strike, administrative decision, or transport strike that delays, prevents, or makes supply exorbitant, constitutes, by express agreement, a clause of suspension or termination of the obligations of the company JOAQUIN ESPALIU, without compensation in favor of the customer if the event lasts more than 15 days. In these circumstances, the customer will be fully and automatically exempt from their obligations regarding their order.
The company JOAQUIN ESPALIU will inform the customer by any suitable means and on the same day the event occurs so that they can freely cancel their orders by responding via postal mail or email once the event is notified.
7/ Shipping company Deliveries will be made by certified mail or courier during normal office hours. Please select the shipping address so that someone can receive the package.
8/ Price All prices are indicated in euros and include VAT. The price invoiced to the customer is the price indicated in the order confirmation sent by JOAQUIN ESPALIU. Payment for products and services is made by credit card in a secure server environment of our provider or by Paypal. The charge to the customer's credit card will be made in euros 2 days after the order is accepted by JOAQUIN ESPALIU. JOAQUIN ESPALIU retains ownership of the products until the customer pays the full price of the products and services.
9/ Product sheet The photographs showing the products are provided for indicative purposes. Differences between the photographs and the products can only be minimal and do not affect the essential characteristics of the products. The color of the products shown in the virtual store may slightly differ from the actual color of the product.
10/ Payment terms The ordered products will be delivered after payment by credit card (Master Card, Visa Card, American Express) and Paypal
11/ Private information security JOAQUIN ESPALIU is committed to protecting your private information. Personal data collected during your connection to our commercial site will only be used to process your order. We will not sell, rent, or disclose your personal data to any person (or third parties).
12/ Requested information By placing orders through the site www.JOAQUIN ESPALIU.com, you consent to the company JOAQUIN ESPALIU using nominative data about you, communicated by you or collected through the operation of the site. This data (names, email address, postal address, credit card number with its expiration date, etc.) is necessary for us to process your orders.
13/ Personal data security The sending of orders (containing information about your account) is done through a secure server. The security program (SSL) encrypts all the information you write before it is sent to us. Additionally, message transmissions are protected against unauthorized access by third parties.
14/ Warranty The customer will benefit from the legal warranty for hidden defects in the products sold. All our products are designed and manufactured with the utmost care. However, the warranty will not be valid if failures or damages occur due to incorrect handling, lack of maintenance, or care contrary to our instructions for use. The buyer must consult the appropriate instructions and recommendations found in the user manual provided with the product.
15/ Right to return goods and withdrawal period The customer has a withdrawal period of fourteen days from the receipt of the goods to return, at their expense, the products* to JOAQUIN ESPALIU in order to exchange them or obtain a refund, to the following address:

* In its original complete packaging (accessories, instructions, etc.) in good condition and accompanied by a copy of the invoice.
16/ Intellectual property When connecting to the website created by JOAQUIN ESPALIU, holder of all intellectual property rights of it, the customer may not copy or download all or part of its content, without prior and express authorization from JOAQUIN ESPALIU
