GENERAL TERMS AND CONDITIONS OF SALE
These general terms and conditions of sale govern all relationships between:
the company JOAQUIN ESPALIU and its online customers (“The customer”).
Before making any transaction, the customer acknowledges having read and declares acceptance of these conditions by clicking on the Accept button.
1/ Specific terms of sale. The customer acknowledges being aware, at the time of placing the order, of the specific terms of sale indicated on the screen (name, price components, weight, quantity, color, product details, cost of services, etc.) and expressly declares acceptance of them without reservation. Placing the order and its confirmation by the customer materialize full and complete acceptance of the specific terms of sale, applicable only to the order.
2/ Order. The customer places the order by clicking on the “add to cart” tab. The order is added to a total that includes all items confirmed by the customer by clicking on the "I accept the general terms and conditions of sale and proceed with payment" button in the menu bar.
3/ Order confirmation. JOAQUIN ESPALIU confirms acceptance of the order to the customer through the means chosen by the customer: email, fax, or postal mail. The sale will not be finalized until the company JOAQUIN ESPALIU confirms the order.
JOAQUIN ESPALIU reserves the right not to confirm an order for a specific reason such as product supply, a problem related to the received order (e.g., illegible document), an abnormal order, or a foreseeable issue regarding delivery. JOAQUIN ESPALIU will inform the customer.
No new orders can be placed until the customer has paid the amounts due for previous orders. Likewise, the ownership of the goods will not be fully transferred until JOAQUIN ESPALIU receives the amounts due from the customer.
4/ Delivery conditions of orders. The customer will choose the place and date of receipt of the goods at the time of placing the order. JOAQUIN ESPALIU reserves the right to use all necessary means to deliver the products to the address indicated by the customer. Deliveries will be made within the territory of Spain (including the Balearic and Canary Islands) and beyond. For international shipments and to the Canary Islands: By accepting the general terms, the customer agrees to pay customs fees.
5/ Delivery times. The standard delivery time for the national territory is 4 to 6 days. However, depending on the selected jewelry and its production process, this period may extend to 15 days or more.
For international deliveries, the delivery time may vary due to the possibility of customs inspections depending on the destination country. Please note that this process may add a few additional days to the estimated delivery time.
All orders will be provided with a tracking number, allowing customers to track the delivery progress at every step of the process.
6/ Delivery costs and order receipt. Shipments will be made by regular transport. The cost, for mainland and Balearic Islands, is included if the purchase price is over €100. For Europe (Belgium, Italy, Netherlands, France, Germany, and the United Kingdom) there will be an additional cost of €15, unless the order exceeds €150.
If the customer notices damaged products or missing items, they must file a claim with the Customer Relations Service by email or postal mail to JOAQUIN ESPALIU, within a maximum period of three days.
Any event such as force majeure, accident, strike, administrative decision, or transport strike that delays, prevents, or makes supply excessively costly, constitutes, by express agreement, a clause of suspension or termination of the obligations of JOAQUIN ESPALIU, without compensation in favor of the customer if the event lasts more than 15 days. In these circumstances, the customer will be fully and automatically exempted from their obligations regarding their order.
JOAQUIN ESPALIU will inform the customer through any suitable means on the same day the event occurs so that the customer can freely cancel their orders by responding via postal mail or email once the event has been notified.
7/ Shipping company. Deliveries will be made by the postal service or courier during normal office hours. Please select the shipping address so that someone can receive the package.
8/ Price. All prices are indicated in euros and include VAT. The price billed to the customer is the price indicated in the order confirmation sent by JOAQUIN ESPALIU. Payment for products and services is made by credit card in a secure server environment of our provider or via PayPal. The charge to the customer's credit card will be made in euros 2 days after acceptance of the order by JOAQUIN ESPALIU. JOAQUIN ESPALIU retains ownership of the products until the customer has fully paid the price of the products and services.
9/ Product details. The photographs showing the products are provided for indicative purposes only. Differences between the photographs and the products can only be minimal and do not affect the essential characteristics of the products. The color of the products shown in the virtual store may slightly differ from the actual color of the product.
10/ Payment conditions. The ordered products will be delivered after payment by credit card (MasterCard, Visa Card, American Express) and PayPal.
11/ Security of private information. JOAQUIN ESPALIU is committed to protecting your private information. The personal data collected during your connection to our commercial site will only be used to process your order. We will not sell, rent, or disclose your personal data to anyone (or third parties).
12/ Information requested. By placing orders through the site www.JOAQUIN ESPALIU.com, you consent to JOAQUIN ESPALIU using nominative data about you, communicated by you or collected through the operation of the site. This data (names, email address, postal address, credit card number with its expiration date, etc.) is necessary for us to process your orders.
13/ Security of personal data. The sending of orders (which contain information about your account) is done through a secure server. The security program (SSL) encrypts all the information you write before it is sent to us. Likewise, message transmissions are protected against unauthorized access by third parties.
14/ Warranty. The customer will benefit from the legal warranty for hidden defects in the products sold. All our products are designed and manufactured with the utmost care. However, the warranty will not be valid if failures or damages occur due to improper handling, lack of maintenance, or care contrary to our instructions for use. The buyer must consult the appropriate instructions and recommendations found in the user manual provided with the product.
15/ Right to return goods and withdrawal period. The customer has a withdrawal period of fourteen days from the receipt of the goods to return, at their expense, the products* to JOAQUIN ESPALIU in order to exchange them or obtain a refund, to the following address:

* In its complete original packaging (accessories, instructions, etc.) in good condition and accompanied by a copy of the invoice.
16/ Intellectual property. When connecting to the Internet site created by JOAQUIN ESPALIU, holder of all intellectual property rights of the same, the customer may not copy or download all or part of its content, without prior and express authorization from JOAQUIN ESPALIU.
